Correct weight distribution on the truck is of great importance for the safety of cargo and people. In addition to being essential to maintain the integrity of the vehicle and equipment. The highest weight concentration should be on the axes of the equipment.
According to the CTB – Brazilian Traffic Code, described in article 257, excess weight in the vehicle has infringement. These offenses are issued on the roadside scales. Vehicle weighing is required. Below, we describe as the CTB the responsibility for payment of the infringement according to the law.
The shipper is liable for the infraction related to the transport of excess weight on the axles or the total gross weight, when at the same time it is the sole sender of the cargo and the weight stated in the invoice, invoice or manifest is lower than that verified.
The carrier is liable for the infringement relating to the carriage of overweight axle cargo or when the load from more than one shipper exceeds the total gross weight.
The carrier and the shipper are jointly and severally liable for the violation of the gross excess weight if the weight stated on the invoice, invoice or manifest exceeds the legal limit.
If the identification of the offender is not immediate, the vehicle owner shall have a period of fifteen days, after notification of the notice, to present it, in the manner in which the CONTRAN disposes, after which, not doing so, will be held responsible for infringement.
