The transport of chemicals is quite complex. In order to embark dangerous products, it is necessary to work with specific criteria that aim at the safety of people and the environment, since these are hazardous, health and life hazards.
To understand what are classified chemicals or not, follows a definition and example of what it is about. They are substances or articles which present a risk to human health, public safety or the environment.
We list some of the key requirements to comply with the current legislation on chemical shipments to clarify the needs of a specialized company and all the care to comply with the legislation.
On the part of the shipper it is necessary to carry the Emergency File, the transport envelope and the UN classification plates and the risk class. On the part of the carrier it is necessary that the drivers attend a specialized school and homologated for training and qualification to transport dangerous products denominated, course MOPP. In the vehicle, it is mandatory to board the Emergency Kit containing the PPE. For the transports that need a helper it is mandatory to carry the Emergency Kit by professional.
In the Transport of a CONTROLLED product, it is required in addition to all these legal determinations, the carrying of licenses for the Transport of Controlled Products that are the License issued by the Civil Police, the Ministry of the Army and the Federal Police. These licenses are renewed every year and every month shipments are declared by the carrier to the competent bodies with the declaration of each product contained in DANFE.
Each control body has a specific role in relation to public health. The responsibility of the Federal Police is to prevent the production of narcotics, especially cocaine paste. The Civil Police supervises the import, export, trade, traffic or use of explosive, flammable, weapons, ammunition and aggressive or corrosive chemicals. It is the responsibility of the Army to control the areas of Industrial Mobilization, War Material and Internal Security; controlling the industries that make use of such products in their manufacturing process.
A product or article is considered to be hazardous to transport when it falls within one of the 9 (nine) classes of dangerous products established in Ordinance No. 420.
Class 1 – EXPLOSIVES
Class 2 – GASES
Class 3 – FLAMMABLE LIQUIDS
Class 4 – Flammable solids; Substances liable to spontaneous combustion;
Substances which, in contact with water, emit flammable gases.
Class 5 – Oxidizing substances; Organic peroxides.
Class 6 – Toxic (poisonous) substances; Infectious substances.
Class 7 – RADIOACTIVE MATERIALS
Class 8 – CORROSIVES
Class 9 – DANGEROUS SUBSTANCES.
It is required the IBAMA, Licenses of the Municipal and State Environmental Organs of the Sanitary Surveillance. ABQUIM issues a certificate named SASSMAQ for carriers that comply with all safety requirements. All certifications and licenses, to obtain them the carrier must have suitability, responsibilities, science of the legislation.
IBAMA is responsible for the preservation and maintenance of the environment. Regarding the Municipal and State Environmental Bodies, the City of São Paulo requires LETPP, a special license for transit of dangerous products, which through the Secretariat of Green and the environment is another competent body that supervises and controls this transportation, which is mandatory for all vehicle that transports classified product within the city. For the issuance of this license it is necessary to issue the PAE – Emergency Service Plan and the hiring of a company specialized in risk containment.
